Terms & Conditions

These terms explain the rules for using the Hoziva website, software, and related services. Please read them before creating an account or using our services.

Last updated: October 26, 2026

These Terms & Conditions (“Terms”) form an agreement between you and Getege Private Limited (“Hoziva”, “we”, “us”, or “our”) concerning your access to or use of the Hoziva website, software, applications, and related products and services (collectively, the “Services”). If you use the Services for a hospital, clinic, laboratory, pharmacy, or other organization, you confirm that you are authorized to accept these Terms on its behalf. In that case, “you” also refers to that organization.

Product-specific terms, order forms, service descriptions, or data-processing agreements may apply to a particular subscription or deployment. If they conflict with these Terms, the product-specific agreement controls for that conflict.

01 Acceptance of these terms

By accessing or using the Services, creating an account, or selecting an option indicating acceptance, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

If you accept these Terms for an organization, you represent that you have authority to bind that organization. Each person using an account remains responsible for their own conduct and for following applicable organizational policies.

02 Hoziva services

Hoziva provides digital healthcare management software and related information, which may support workflows such as patient administration, electronic records, appointments, clinical documentation, laboratory or pharmacy operations, billing, and reporting. The available features depend on the product, configuration, subscription, and deployment agreed with you.

Website pages describing products are general information, not a binding offer or guarantee that a particular feature, integration, certification, or outcome is included in your service. Product scope, implementation, support, service levels, and fees are governed by the applicable order form or separate written agreement.

03 Eligibility and accounts

You must provide accurate, current information when creating or maintaining an account and keep it updated. You are responsible for safeguarding account credentials, restricting access to authorized users, and promptly notifying us if you suspect unauthorized access or a security incident involving your account.

Accounts and credentials must not be shared in a way that bypasses user permissions or licensing limits. You are responsible for activities performed through your accounts, except to the extent caused by our breach of an applicable agreement or non-excludable legal obligation.

04 Permitted use

You may use the Services only for lawful purposes and in accordance with these Terms, your subscription, and applicable professional and organizational requirements. You must not, and must not permit another person to:

  • Use the Services in violation of law, a patient's rights, or another person's intellectual property or privacy rights.
  • Attempt unauthorized access to an account, system, network, or data, or interfere with the security, integrity, or operation of the Services.
  • Upload malicious code, conduct abusive testing, or use the Services to send unlawful, deceptive, or unsolicited material.
  • Reverse engineer, decompile, copy, resell, lease, or create derivative works from the Services, except where applicable law does not allow that restriction.
  • Use the Services or their output to develop or benchmark a competing service, or to train a model, without our prior written permission.
  • Misrepresent your identity, authority, professional credentials, or right to access information.

We may investigate suspected misuse and take proportionate action to protect users, patients, our systems, and the Services, subject to applicable law and any customer agreement.

05 Healthcare and clinical responsibility

The Services are administrative and information-management tools. They are not a substitute for professional medical judgment, diagnosis, treatment, emergency services, or direct communication between a patient and a qualified healthcare professional. Unless a separate written agreement expressly states otherwise, Hoziva does not provide medical care and does not make clinical decisions for you.

Healthcare professionals and organizations remain responsible for patient assessment, clinical decisions, prescriptions, treatment, review and verification of records and results, and compliance with professional standards. Do not rely on the Services as the sole means to identify an emergency, alert a clinician, or monitor a patient. In an emergency, contact the appropriate emergency service or healthcare professional.

You are responsible for determining whether the Services are appropriate for your intended clinical or operational use and for providing required training, supervision, and human review.

06 Customer data and privacy

“Customer Data” means information, records, files, or other content that you or your authorized users submit to or manage through the Services. As between you and Hoziva, you retain your rights in Customer Data. You are responsible for ensuring that you have the necessary rights, notices, permissions, and lawful basis to collect, use, and provide Customer Data through the Services.

You authorize Hoziva to host, process, transmit, and use Customer Data only as reasonably necessary to provide, maintain, secure, and support the Services, comply with law, and perform the applicable agreement. The parties' specific privacy and data-protection roles and obligations will be described in the applicable privacy notice, data-processing terms, or customer agreement; these Terms do not by themselves determine a party's legal role for every processing activity.

Our collection and handling of personal information through the website and Services are described in the Privacy Policy. You must not submit information you are not authorized to share. You are responsible for configuring user access appropriately and for maintaining any records or backups required by your organization or law.

07 Third-party services

The Services may link to or work with third-party platforms, devices, laboratories, payment providers, or other services. Those services are governed by their own terms and privacy notices. Unless a written agreement states otherwise, Hoziva does not control and is not responsible for third-party services, their availability, or the accuracy of information they provide.

Integrations are subject to technical compatibility, permissions, third-party availability, configuration, and implementation. A feature or integration described on the website may not be available in every deployment.

08 Intellectual property

Hoziva and its licensors own the Services, including related software, designs, text, graphics, logos, and documentation, except for Customer Data and third-party materials. These Terms do not transfer ownership to you.

While you comply with these Terms and any applicable subscription, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for your internal business or professional purposes. You may not remove proprietary notices or use Hoziva names, logos, or marks without prior written permission.

If you provide suggestions or feedback, you permit us to use them without restriction or compensation, provided we do not identify you publicly as the source without permission.

09 Fees and subscription terms

Fees, billing intervals, taxes, subscription duration, renewal, and cancellation terms for paid Services are set out in the applicable order form or written agreement. You agree to pay charges specified there. Unless that agreement or applicable law provides otherwise, payments are non-refundable.

These Terms do not create a paid subscription or specify a price. If a product-specific agreement conflicts with this section, that agreement governs the relevant fees and subscription terms.

10 Availability and changes

We may update, maintain, or modify the Services from time to time. We will make reasonable efforts to communicate material changes that affect an active paid subscription, as required by the applicable agreement or law. We do not guarantee uninterrupted or error-free availability through these website Terms.

Availability may be affected by maintenance, internet or telecommunications failures, third-party services, security events, or circumstances beyond our reasonable control. Any service levels or support commitments apply only if included in a separate written agreement.

11 Suspension and termination

You may stop using the website at any time. Account closure, subscription cancellation, data export, and deletion for a paid or deployed product are governed by the applicable order form or customer agreement and applicable law.

We may suspend access where reasonably necessary to address a security risk, unlawful use, material breach, or threat to the Services or another person. Where practicable and lawful, we will provide notice and an opportunity to address the issue. Termination rights and any data retrieval period for a subscribed service are governed by the applicable customer agreement.

Terms that by their nature should continue after termination—including intellectual property, disclaimers, liability, indemnity, and dispute provisions—will survive to the extent applicable.

12 Disclaimers

To the maximum extent permitted by applicable law, the website and Services are provided “as is” and “as available,” except for express commitments in a separate written customer agreement. We disclaim implied warranties and conditions, including merchantability, fitness for a particular purpose, and non-infringement, to the extent the law permits.

We do not warrant that website information is complete or current for every purpose, that the Services will meet every workflow or regulatory requirement, or that the Services will be continuously available, secure, or error-free. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

13 Limitation of liability

To the maximum extent permitted by applicable law, neither party will be liable to the other under these website Terms for indirect, incidental, special, consequential, exemplary, or punitive losses, or for loss of profits, revenue, goodwill, or anticipated savings. This does not limit liability that cannot lawfully be limited.

For a paid or deployed service, any agreed liability limits, exclusions, and remedies are set out in the applicable customer agreement. If no such agreement applies, each party's liability remains subject to applicable law and this section. Nothing in these Terms limits liability for fraud, wilful misconduct, or any other liability that cannot legally be excluded or limited.

14 Indemnity

To the extent permitted by law, you are responsible for claims, losses, and expenses arising from your unlawful use of the Services, your violation of these Terms, or Customer Data you provide without the required rights or permissions. This does not apply to the extent a claim is caused by Hoziva's breach of an applicable agreement, negligence, or wilful misconduct. Any indemnity for a subscribed product may be governed by the customer agreement.

15 Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory rights or jurisdiction that applicable law provides, courts located in Lucknow, Uttar Pradesh, India will have jurisdiction over disputes relating to these Terms or the website.

Disputes relating to a subscribed or deployed product may be subject to dispute-resolution terms in the applicable customer agreement. Nothing in this section restricts a consumer or other person from exercising a right that cannot lawfully be waived.

16 General terms

Changes to these Terms. We may revise these Terms by posting an updated version on this page and changing the “Last updated” date. Material changes will be communicated as required by law or an applicable agreement. Continued use after the effective date of an update means you accept the revised Terms, to the extent permitted by law.

Severability and waiver. If a provision is found unenforceable, the remaining provisions remain effective. A failure to enforce a provision is not a waiver of the right to enforce it later.

Assignment. You may not assign these Terms without our prior written consent, except where applicable law allows. We may assign these Terms as part of a merger, restructuring, or transfer of substantially all relevant business assets, subject to applicable law.

Entire agreement. These Terms and any applicable product-specific written agreement form the agreement about the subject matter they cover and replace prior understandings on that subject. If there is a conflict, the product-specific written agreement controls for the relevant service.

Force majeure. Neither party is responsible for delay or failure caused by circumstances beyond its reasonable control, except for payment obligations already due and to the extent the law requires otherwise.
